Marriage in Islam

 

In Islam, marriage is a contract between a man and woman to live as husband and wife. A formal, binding contract is considered integral to a religiously valid Islamic marriage, and outlines the rights and responsibilities of the groom and bride. The marriage must be declared publicly. Divorce is permitted and can be initiated by either party. Homosexuality is widely considered a sin in Islam. Same-sex marriages hence are not performed or permitted. However, there are reformist movements within Islam arguing that, while homosexual lust is a sin, homosexual love is not. Islam "the religion of real life" gives us the way through Quran, in which Muslims can marries four times in the boundaries given by Islam. But in other religions there is no permission to marry more than once, so non Muslims are converting to Islam. What is "ILLEGAL" and "SINFUL" in other religions and societies Islam gives permission for that and Quran calls it "LEGAL". People turning to Islam in papers only but in real they return to their own religion after marriage. Misuse of religion just for sake of enjoying sex through second marriage should be practically prohibited by amending relevant laws including Muslim Law. Second marriage by any person after conversion to Islam should be made non-bail able offence even though first wife might not have raised any objection. Islamic scholars and institutions have also condemned such tactics by making it clear that adoption of Islam just for marriage-purpose is anti-Islam. There are many Hindus who adopt Islam symbolically only for having a second marriage legally even though in practical life they have faith and belief in Hinduism for all practical purposes performing all Hindu rituals in day-to-day life. Even Hindu law should be amended so that having second wife may attract criminal punishment including holding such marriage illegal even though first wife might not have objected to second marriage. Many of Muslim Males have also married with girls belonging to the other religions. In India this is being start like a practice after one by one Muslim males offering marry to the Hindu girls, this seen recently when Indian actor Saif Ali Khan married with an Indian Hindu Star Karina Kapoor , while, Shahrukh Khan married Gauri and Amir’s first wife was Rita, a Hindu. Cricketer Azzharuddin married Sangeeta Bijlani. Muslim men are permitted by Islamic Law to marry up to four non-Muslim women, provided that all of the children are ensured to be brought up as Muslims. The conversion of the wives to Islam is encouraged, but not obligatory, as their children will legally be Muslim regardless. The early jurists of the most prominent schools of Islamic jurisprudence ruled in fiqh law that the marriage of a Muslim man to a Christian or Jewish woman is makruh (disliked) if they live in a non-Muslim country. Caliph Umar (634–644), a rightly guided Caliph, denied interfaith marriage for Muslim men during his command of the ummah. Notable scholar Bilal Philips has said the verse that permits Muslim men to marry non-Muslim women is not valid anymore today due to several reasons including its misunderstood interpretation. The laws governing Islamic marriage vary substantially between sects, schools, states and cultures. The following outline is general in nature. Marriage is mentioned in the Quran: Nikah. It aims to be permanent, but can be terminated by the husband in the talaq process, or by the wife seeking divorce using khul'. In nikah the couples inherit from each other. A dowry known as mahr is given to the bride, a legal contract is signed when entering the marriage, and the husband must pay for the wife's expenses. For the contract to be valid there must be two witnesses. The Muslim woman may marry only a Muslim man. Permission for a virgin female to marry must be given by her guardian, usually her father. Any Muslim woman may demand her guardian marry her to a Muslim male, provided he is suitable. If the guardian refuses, a judge will effect the marriage. The father, or in some cases the paternal grandfather, may choose a suitable partner for a virgin girl. Without the permission of the girl an Islamic marriage is considered invalid..
